The Constitutional Court refused to consider the so-called Tabelebi case by the liberty institute

The Liberty Institute appealed about the obligation to record working hours and considers that the obligation to fill in the tables is unnecessary, imposes additional work on the employee, makes life difficult, and does not bring any good in return.

Judges Giorgi Tevdorashvili, Irine Imerlishvili and Teimuraz Tughushi expressed a dissenting opinion from the court.

According to them, the claim was sufficiently argued for the court to consider the case on its merits.

The lawsuit sufficiently described the risks of unjustified restriction on the freedom of entrepreneurship to the degree that was sufficient to held the complaint admissible. "The Constitutional Court should have evaluated the restriction established by the disputed provision in terms of interference with the freedom of the entrepreneurial subject and ... should have determined the proportionality of the imposed regulation”.
